SpicyGear.com is operated by Yabai Distribution LLC DBA SpicyGear.com (“SpicyGear,” “we,” “us”). By using this site or placing an order, you agree to these Terms and Conditions and to our Privacy Policy. If you don’t agree, please don’t use the site.

SpicyGear.com is for adults only. You must be at least 18 years old, and of legal age to buy adult products where you live, to use this site or place an order. If you are under 18, you may not use SpicyGear.com, even with a parent’s or guardian’s permission.

Order acceptance: your order is an offer to buy. We accept it when we ship it. We may decline or cancel any order, including orders that appear fraudulent or exceed reasonable quantities. If we cancel an order you’ve already paid for, we’ll refund you in full.

Pricing errors: we work hard to keep prices and product details accurate, but mistakes happen. If an item is listed at an incorrect price, we may cancel the order and refund you, or contact you before shipping.

Payment: we accept major credit and debit cards through WooPayments (powered by Stripe) and PayPal. Prices are in U.S. dollars, and applicable taxes and shipping are shown at checkout before you pay.

Promo codes: coupons and promotions apply only as stated, can’t be combined unless the offer says so, and exclude certain brands. See Promo Exclusions. We may end or change a promotion at any time.

Cancellations: to cancel, contact us within 12 hours of placing your order. We can cancel only if the order hasn’t shipped yet.

Every order ships in plain, discreet packaging. Shipping options, costs, and delivery estimates are shown at checkout and on our Shipping Information page. Delivery times are estimates, not guarantees. Once your package is handed to the carrier, delays are outside our control, but we’ll always help you track it down.

Because of the intimate nature of what we sell, opened products can’t be returned or exchanged unless they’re defective. This protects every customer’s health and safety, and we never resell opened items.

• Unopened items: may be returned within 30 days, subject to a 35% restocking fee.

Product descriptions, sizes, and photos come from manufacturers and our own testing. Colors and packaging may vary slightly.

Our products are intended for adult personal use. Always follow the manufacturer’s instructions, use body-safe lubricant suited to the material, and clean products before and after use. You agree to indemnify, defend, and hold harmless SpicyGear, its owners, employees, and suppliers from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the site, your violation of these Terms, or your violation of any rights of another.

If we can’t resolve a dispute informally, any dispute arising out of or relating to these Terms, whether in contract, tort, or otherwise, shall be resolved only by final and binding arbitration under the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association or a similar service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered on it in any court with jurisdiction. The arbitrator shall decide the entire dispute, including the scope and enforceability of this provision. In any action, proceeding, or arbitration arising out of these Terms, the prevailing party is entitled to recover its costs and reasonable attorneys’ fees. This provision survives the termination of these Terms.

ANY ARBITRATION OR CLAIM UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS. CLASS ARBITRATIONS AND CLASS, REPRESENTATIVE, OR COLLECTIVE ACTIONS ARE NOT PERMITTED. EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

To the maximum extent permitted by law, these Terms are governed by the laws of the State of Florida, and you consent to the exclusive jurisdiction and venue of courts in Florida for any dispute not subject to arbitration. If you access the site from outside the United States, you’re responsible for complying with your local laws.

We may end or restrict your access to the site at any time, without notice. If any part of these Terms is found unenforceable, it will be replaced by an enforceable provision that most closely matches its intent, and the rest of the Terms remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and SpicyGear regarding the site.

We may update these Terms from time to time. The updated version takes effect when posted, and your continued use of the site means you accept the changes.
